Additional measures transportation of Palm Kernel Expeller

Because PKE basically falls under UN1386, Hazard Class 4.2, the sender/ consignor must ensure that the transport takes place in accordance with the hazardous substances legislation.

This can be done in two ways:

  1. The lot is transported in means of transport according to the hazardous substances legislation (ADN ship, ADR truck, or RID train), or;
  2. The consignor / sender demonstrates on the basis of article 2.2.42.1.7 of the ADN / ADR / RID that the PKE to be transported is not subject to the conditions of the classification criteria. The consignor / sender can demonstrate this by completing the Safety Data Sheet (SDS) in accordance with the filling-in instruction and ensuring that the completed SDS is delivered with the cargo documents.
    The ADN / ADR and RID offers in Par. 2.2.42.1.7 the possibility of making an exception, whereby the consignor/ sender of the load may declare that the substance does not meet the classification criteria for class 4.2 solids susceptible to spontaneous combustion. This can be demonstrated by performing an N4 test with each shipment. However, this is -as you are aware- not feasible for practical reasons. An alternative is to have the supplier declare by means of a safety data sheet or a Safety Data Sheet (SDS) that the goods do not constitute a hazard during transport by ship, train or car. Since there was no SDS for Palm Kernel Expeller, a safety data sheet was drawn up for the Dutch Grain and Feed Trade Association (Het Comité) in accordance with Regulation EC 1907/2006 (REACH model). This SDS can demonstrate to the competent authorities that PKE is covered by this exception.
