Arbitration

‘Het Comité’ has operated an internationally recognised arbitration institute since 1896. Parties trading under the Conditions of the Dutch Grain and Feed Materials (CNGD) and that have an unresolved conflict of interests or a difference of opinion may ask ‘Het Comité’ to appoint independent arbitrators. The arbitrators are members of ‘Het Comité’ and are elected annually in ballots among the members. In the first instance, arbitration usually proceeds as follows:

1. You (the claimant) notify us in writing of your petition for arbitration. If possible, you should specify the commodity, the nature of the dispute, the value at stake and the details of the other party. You must also simultaneously serve notice of the arbitration on the other party.

2. We will register and assign a number to the arbitration case. We will then ask you to send us the deposit and your statement of claim (six copies).

3. After we receive the deposit and your statement of claim, we will send one copy of the statement to the other party and ask that other party (the respondent) to send us its response (also six copies).

4. Even if the other party does not file a response, a date for a hearing can be set. 

5. ‘Het Comité’ will appoint three arbitrators.

6. The parties will be invited, by registered letter, to appear at the institute on a specific date. At the same time, the claimant will receive a copy of the respondent’s response.

7. The respondent may submit a counter-claim against the claimant up until the first day of the hearing (inclusive) and must then deposit an amount for the counter-claim.

8. After the hearing, the arbitrators will publish their decision in an award of arbitration.

Companies who have failed to comply with an arbitral award 

If either of the parties in an arbitration does not comply with an award of the arbitrators, the Dutch Grain and Feed Trade Association shall be permitted to announce this in any way it deems fit.
